An Open Letter of Complaint against the Xiao Procedure

We are a group of volunteers who are alarmed by the ongoing public misrepresentation and misinformation on an experimental surgical procedure invented by Xiao Chuanguo, M.D., from China. The procedure, sometimes referred to as “Xiao Procedure”, is designed to treat neurogenic bladder due to spina bifida or spinal cord injury and has been undergoing clinical trials in China, United States, and a few other countries.

We initially learned about this procedure when Dr. Xiao was exposed for committing several academic misconducts on the New Threads (www.xys.org), a website that is committed to fighting against China’s academic corruption, plagiarism, and fraud. In the last five years, we have been closely following the case and have become seriously concerned about the effectiveness of the Xiao procedure and the risks associated with it. Indeed, the problems of the procedure have recently drawn the attention of Chinese media, and extremely shocking findings have been published after investigations.

In this Letter, we summarize a few facts about the procedure below. We hope to bring them to the attention of the National Institutes of Health (NIH) who funds the trials, and the institutional review boards (IRBs) of the hospitals where the trials are currently undergoing, and any current or potential patients of the trials.

How Xiao Procedure Trials Started in U.S.

The clinical trials on the so called “Xiao Procedure” are currently undergoing in the U.S. [a, b], despite of the fact that the procedure has long been questioned in China and recently found by Chinese lawyers and reporters to be ineffective and risky. We thus raise the question: how could the clinical trials have started in the U.S.? We find the answer after thoroughly examining the information from different sources: Dr. Xiao Chuanguo provided false or dubious information regarding his procedure, and some hospitals in the U.S. accepted Dr. Xiao’s self-claim without discrimination.

Local Chinese Court Steals Money from Fang Zhouzi’s Wife

One of the most significant fraud case exposed by Fang Zhouzi was that involving Professor Xiao Chuanguo, a self-claimed world-famous urologist. The case first came to light in September, 2005, when Xiao Chuanguo was being nominated to become an Academician. Fang Zhouzi publicly accused Xiao Chuanguo for having engaged in various acts of exageration in his credentials.

Xiao Chuanguo’s Academician candidacy was then denied by Chinese Academy of Science. Xiao Chuanguo blamed his lose entirely on Fang Zhouzi’s words and sued the later in local courts in Wuhan, Beijing, as well as New York.

Rao Yi’s opinion on Xiao Chuanguo vs. Fang Zhouzi case

One prominent intellectual who was outraged by Xiao Chuanguo’s lawsuit and open letter was Rao Yi (饶毅), then the Steiner Elsa A. Swanson Research Professor at Northwestern University. On September 6, 2006, Professor Rao Yi published an open letter of his own, practically denouncing Xiao Chuanguo’s public behavior as brain-dead.

Because of this letter, Professor Rao Yi later became a co-defendant with Fang Zhouzi in a libel suit of one million dollar demand filed by Xiao Chuanguo in New York. There are full of false accusations in Xiao’s complaint, such as “the plaintiff … was denied an appointment to the Chinese Academy of Science” as a result of Rao’s opinion, whereas Xiao failed to become a CAS member far before the opinion was published. Nevertheless, the case between Xiao and Rao was said having been settled out of court.

Professor Rao Yi has left Northwestern and become the Dean of School of Life Sciences at Peking University in China.

An open letter by intellectuals in China and abroad on the lawsuit of Xiao Chuanguo vs. Fang Zhouzi case

In the summer of 2006, as a response to Professor Xiao Chuanguo’s lawsuit and his open letter, another open letter was circulating the internet collecting signature to support Fang Zhouzi. The letter was eventually signed by more than 600 intellectuals both in China and abroad. By the rule, all signatures are supposed to be real names, accompanied by their work address.

Later, Xiao Chuanguo hired a couple of law firms in China to “investigate and seek prosecution” of the letter signatories. To date, this has been shown as an empty threat.

Xiao Chuanguo’s open letter to all media in the nation, all fellows in academia and Fang Zhouzi

On June 8, 2006, days before the legal proceedings started in Wuhan court, Professor Xiao Chuanguo published an open letter to “all media in the nation, all fellows in academia and Fang Zhouzi” regarding his case. It is an unusual letter for a professor and an Academician candidate, as it was filled with vengeance, hatred, personal attacks towards Fang Zhouzi, and occasional profanity.
